Q & A
What will happen to zoning in the unincorporated area outside of the proposed boundary of Oceanside Village? In the near term, land use standards for all of unincorporated Oceanside will remain in place until the Oceanside Village community and its elected council formulate a new comprehensive land use plan and zoning ordinances - which can take up to four years. During that transitional period, Tillamook County officials would simultaneously conduct a public process to structure ongoing land use planning for southern Oceanside in the long term. This is expected to be a collaborative process between Oceanside Village and Tillamook County officials. The OVI team has advised the county that its proposal does not contemplate that Oceanside Village would assume any land use planning responsibility for southern Oceanside from Tillamook County.
Could Oceanside Village annex southern Oceanside involuntarily in the future? Contrary to incorrect statements circulated in social media, absent a declared health emergency, an urban growth boundary area may not be annexed into a city without property owner consent (for individual properties) or (for larger areas) a majority vote by affected residents. State land use agency officials have expressly confirmed this, and here is a link to the Oregon statute that addresses it - it's in paragraph (4). ORS 222.120 – Procedure for annexation without election; hearing; ordinance subject to referendum. The rare exception is when a growing city completely surrounds an unincorporated area, which will not apply to our situation with Netarts already bordering the area on the south.
Would this initiative result in an increase in property taxes? A vote in favor of incorporation will not automatically create a city property tax, but it does create legal authority for the new city council and its residents to subsequently consider whether to assess one, and if so, how much. Under state law, that future decision must be arrived at in a budgeting process open to the public that also includes public hearings.
To get the incorporation measure on the ballot, however, the petitioners must specify a legally binding cap on whatever that future tax rate could be and then offer hypothetical budgets based the planned services and potential revenue. We have covered this in the draft "Economic Feasibility Statement" (page 9) available under "Can We Afford it?" at the bottom of our WELCOME page (click here). The EFS adopts a "bookends" approach that offers alternative budgets based on a minimal tax rate and a maximum rate. Compared to the 2022 initiative, these budgets reflect a more modest fiscal approach in which most of the cost of city services is covered by external grants and tourism lodging tax revenues (TLT) paid by visitors to the Village's short-term rentals and hotels. Village TLT currently totals more than $500,000 a year.
